1.2 Buyer

The natural or legal person who buys the service. The buyer’s name or company name, address, phone, email and billing details are those given in the written quote, on the PayTR payment page and on the invoice.

Article 2. Subject

This agreement sets out the rights and obligations of the parties for the sale and performance of the website design, setup and hosting service that the buyer orders by distance communication (email, WhatsApp or a PayTR payment link) and that the seller provides.

Article 3. Main characteristics of the service

  • Website design and setup: preparing a website designed for the buyer’s work, connecting it to the buyer’s domain and publishing it with an SSL certificate.
  • Hosting: keeping the site, and where needed its database, archive or collection, online on a server managed by the seller; keeping the server updated and secure, renewing the SSL certificate, daily backups; moving an existing site, its data and email accounts when needed.
  • Extra work: interactive 3D models, an extra language, an admin page for posting content.

The scope of each order (pages, content, revision rounds, delivery time) is set out in the written quote or signed agreement. Where the quote contains a special term that differs from this agreement, that term applies; consumer rights under the law are always reserved.

Article 4. Price and payment

4.1 The price is shown as a total including taxes in the written quote and on the payment link. The standard website price is $500 for buyers outside Türkiye and 25,000 TL + VAT for buyers in Türkiye. For a standard site the first year of hosting is included; after that hosting is $100 or 5,000 TL + VAT per year. For work that needs a separate server, a database or a move, and for any other scope, the price is set in the quote. Hosting is billed yearly in advance.

4.2 Payment is made by credit or debit card through PayTR (using the payment link sent to the buyer) or by bank transfer to the seller’s account. Buyers outside Türkiye may pay in USD.

4.3 The quote states whether payment is taken at once or in stages (for example half at the start and the rest when the work is finished and the buyer confirms it). The preview is free; no payment is taken before the buyer has seen and liked it.

4.4 Card details are processed by PayTR; the seller never sees or stores them.

4.5 The seller issues the invoice electronically using the details the buyer provides. For buyers outside Türkiye, VAT is applied according to the export of services exemption in Turkish law.

Article 5. Performance and delivery

5.1 The services are delivered digitally; nothing physical is shipped and there is no shipping charge.

5.2 During preview and refinement the website is shared with the buyer at the seller’s preview address. Delivery takes place when the site is published on the buyer’s domain and the seller confirms this by email.

5.3 The delivery time is stated in the quote. Unless agreed otherwise in writing, delivery takes place within 30 days from the date the seller receives the payment and the content for the site (text, images, logo). Delays in sending content or giving approval extend this period accordingly.

5.4 Hosting starts on the day the site is published (for moves, the day of the switch to the new server) and runs for 12 months; it is extended by another 12 months when the buyer pays the renewal. For moves, the switch is made only after the buyer confirms that everything works.

5.5 Either party may end hosting with 30 days’ written notice by email. The site stays online until the end of the paid period.

5.6 The domain, content and data belong to the buyer. On request, and when hosting ends, the seller gives the buyer a full backup of the site and data and helps move it to another host.

Article 6. Right of withdrawal

6.1 A buyer who is a consumer may withdraw from the agreement within 14 days of its formation, without giving a reason and without penalty, by writing to yagiz@artirfs.com or to the seller’s address within that period.

6.2 Under article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services whose performance has started, with the consumer’s approval, before the withdrawal period ends. By paying, or by asking in writing for work to begin, the buyer requests that the service start within the withdrawal period and accepts that the right of withdrawal is lost once work has started. Refunds are then made under the Refund and cancellation terms.

6.3 When the right of withdrawal is used, the seller refunds the full amount within 14 days of receiving the notice, using the same payment method and at no cost to the buyer.

6.4 The consumer right of withdrawal does not apply to buyers acting for business or professional purposes; the Refund and cancellation terms apply to them.

Article 7. Obligations

7.1 The seller performs the service carefully and on time, as described in the quote and this agreement.

7.2 The buyer provides the text, images, logos and other content for the site on time and declares that it holds the necessary rights to that content. Legal responsibility for the content lies with the buyer.

7.3 The seller uses any logins the buyer provides only for this work and recommends changing the passwords once the work is finished.

7.4 If the delivered service falls short of the quote, the buyer tells the seller and the seller fixes it free of charge. Consumer rights for defective services under Law No. 6502 are reserved.

Article 8. Personal data

The buyer’s personal data is processed in line with Turkish Personal Data Protection Law No. 6698 as explained in Privacy and KVKK.

Article 9. Complaints and disputes

9.1 For complaints and requests write to yagiz@artirfs.com or call +90 507 577 37 40.

9.2 Consumer buyers may apply to the Consumer Arbitration Committee where they live or where they bought the service, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Court above those limits.

9.3 For disputes with business buyers, the courts and enforcement offices of Ankara have jurisdiction. Turkish law governs this agreement.

Article 10. Entry into force

By accepting the written quote and paying, the buyer declares that it has read, understood and accepted this preliminary information and every term of this agreement. The agreement is formed when the payment is approved. The text on this page and the invoice are sent to the buyer’s email address.
